These Terms of Service apply to this website, the chat window on it, and Ask Mortgage text messages. They are an agreement between you and Ask Mortgage Technologies LLC, a Florida limited liability company (“Ask Mortgage,” “we,” or “us”).

1. SMS messaging terms

Program description

Ask Mortgage Technologies LLC sends text messages to customers and website visitors who opt in through the chat widget on our website at https://ask.mortgage by entering their mobile number and checking the SMS consent box. Messages may include replies to your inquiries, appointment and meeting scheduling and reminders, service updates, customer support, and occasional promotional offers. Consent to receive text messages is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance.

Cancellation

You can cancel text messages at any time. Text STOP to the number that sent you messages. We will send one message confirming that you have unsubscribed, and after that you will no longer receive text messages from us. To rejoin, opt in again through the chat on this website.

If you have trouble with the messaging program, reply HELP, call us at (888) 271-4275, or email support@ask.mortgage.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Message and data rates

Message and data rates may apply to messages we send to you and messages you send to us. For questions about your text or data plan, contact your wireless provider.

Age requirement

You must be 18 years of age or older to take part in the messaging program.

Consent

Consent to receive text messages is not a condition of purchase. Agreeing to these Terms of Service or our Privacy Policy does not by itself sign you up for text messages.

We send text messages in accordance with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

2. General terms

This website (the “Site”) is owned and operated by Ask Mortgage Technologies LLC. By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with them and with our Privacy Policy.

Accessing the Site in any manner, whether automated or otherwise, is use of the Site and means you agree to these Terms of Service.

3. About Ask Mortgage and the information on this Site

Ask Mortgage Technologies LLC is a software company. It is not a lender or mortgage broker, and it does not make loans, take loan applications, set rates, or approve borrowers. Information on the Site and in the chat is general information about Ask Mortgage and its software. It is not financial, legal, or tax advice, a loan offer, or a commitment to lend.

4. Intellectual property

Our limited license to you

The Site and the materials on it are the property of Ask Mortgage Technologies LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may use the Site for your own informational purposes.

You may not use the Site or its materials in a way that infringes our rights or that we have not authorized. What you send us

You are responsible for the messages you send us through the chat or by text. Send only information you have the right to share, and do not send Social Security numbers, bank account or login details, or financial documents. We handle what you send as described in our Privacy Policy.

5. Disclaimers

The Site, the chat, and the information provided through them are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

You agree to indemnify and hold harmless Ask Mortgage Technologies LLC and its members, managers, employees, and agents from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms of Service.

6. Termination

We may suspend or end your access to the Site or the chat, without notice, if we determine that you have violated these Terms of Service or engaged in conduct that is inappropriate or unlawful. Upon termination, you must stop using the Site.

These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising under these Terms of Service will be brought in the state or federal courts located in Florida.
